Just like many of us have warned, the corruption and grift have been going on for a looong time.

1996. Then-directors Rick Carone and Ronin Colman distributed this report on massive financial misconduct to the entire board, which in the end did nothing. At that time, the board policy that contracts for more than $100,000 must be approved by the president and one vice-president had been in effect for five years. The treasurer was required to bring a book of existing contracts to each meeting of the Finance Committee, where any member could review it. NRA’s financial operations seemed very transparent.

The report found that LaPierre and Phillips were getting around those requirements by making verbal contracts with major vendors “off the books.” These were not approved by the president and a VP, and weren’t revealed to the Finance Committee. 171 vendors had contracts exceeding $100,000, but “only a small handful” had one in writing.

NRA had planned, long before all the scandals arose, to re-incorporate in a state other than NY. (Ex-directors have told us those proposals go back to the 1990s; it’s obvious that NRA being a NY corporation, and subject to NY legal control despite its HQ being in DC/Virginia, was a bad idea.) The major barrier to legally relocating was knowledge that that would trigger an audit by the NY Attorney General, which would expose NRA leadership’s financial scandals.

Everyone was required by court rule to file witness lists (with estimated time for the testimony) and exhibit lists, yesterday. Here are New York’s exhibits and witnesses, and NRA’s exhibits and witnesses.

NY has over 5,000 exhibits; NRA has over 800. NY may call 36 witnesses, NRA may call 47. (All these are maximums).

NY witnesses: Many former directors — Oliver North, Rocky Marshall, Esther Schneider, Judge Journey, Pete Brownell, Ronin Colman, Frank Tait, Sean Malone. Other former insiders- Tony Makris, Josh Powell, Chris Cox.

NRA Heading to Court One Way or Another

In a cliffhanger twist worthy of a “B” movie, the NRA has scheduled a brief meeting of the Board of Directors for this Friday. No one except a few – two or three – insiders at the top of the NRA knows what to expect from that Board meeting, though speculation has been running rampant. Most of the speculation leans toward the possibility that the Board will be asked to authorize another attempt at bankruptcy. LaPierre already tried that once back in January of 2021, only to have the petition tossed out of court for having been filed in bad faith – this after spending tens of millions of dollars on the attempt and exposing all sorts of operational and financial information to public scrutiny. The Texas bankruptcy judge determined the Association was not in financial jeopardy but was using the bankruptcy to avoid trial in the NY lawsuit.

Under the bylaws, the head of General Operations becomes acting Executive Vice President. One month ago, Joe DeBergalis was head of General Operations, when he was suddenly replaced by Andrew Arulanandam, a PR person with no experience in General Operations or in management. Rumor had it that DeBergalis had no use at all for the Brewer Law Firm, while Andrew worked with Brewer’s PR branch.
